These Terms & Conditions ("Terms") form a binding agreement between you and Philiabit ("Philiabit", "we", "us") governing your access to and use of the Philiabit mobile application and website (the "Service").

By creating an account, tapping "I agree," or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service.

• You must be at least 13 years old to create an account (or the minimum age of digital consent in your country, if higher).
• If you are under the age of majority in your jurisdiction, you confirm you have permission from a parent or legal guardian to use the Service.
• You must provide accurate registration information (a valid email address and a unique username) and keep it up to date.
• You may not use the Service if you have been previously banned or suspended, or if doing so would violate applicable law.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

We use JWT-based authentication with secure, encrypted local storage of your session token. We may ask you to verify your email address to activate certain features and to help keep the community authentic.

When using Philiabit, you agree to:

• Use the Service only for lawful, personal, non-commercial purposes unless we've separately agreed otherwise in writing.
• Provide truthful proof submissions that genuinely reflect your own habit or challenge completion.
• Treat other members respectfully in chats, comments, stories, and challenge groups.
• Keep your device and app updated, and report bugs, security issues, or abusive behavior you encounter.

You may not use Philiabit to:

• Post or share content that is illegal, hateful, harassing, sexually explicit, violent, or that infringes someone else's rights.
• Impersonate another person, misrepresent your affiliation with anyone, or create a fake or duplicate account.
• Submit fabricated, staged, reused, stolen, or digitally manipulated proof to falsely claim challenge or habit completion.
• Attempt to manipulate XP, coins, levels, streaks, or leaderboard rankings through exploits, bots, scripts, or multiple accounts.
• Reverse-engineer, decompile, scrape, or interfere with the Service, or bypass rate limits, security controls, or certificate pinning.
• Use another user's contact information, photos, or content without permission, or harvest data about other users beyond normal in-app use.
• Upload malware, spam, or promotional content unrelated to genuine habit-building.

"User Content" means anything you upload, post, or submit through Philiabit — profile photos, proof photos/videos, stories, comments, posts, and chat messages.

You retain ownership of your User Content. By posting it, you grant Philiabit a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely to operate and improve the Service — for example, showing your proof to your challenge group, or your public profile to other members per your privacy settings.

This license ends when you delete the specific content or your account, except for content already shared with, or approved by, other users (e.g., a proof approval history) or copies retained briefly for backup, legal, or safety purposes as described in our Privacy Policy.

You confirm you own or have the necessary rights to any content you post, and that it does not infringe any third party's intellectual property or privacy rights. See our Content & Copyright Policy for details, including how to report infringement.

The Philiabit name, logo, app design, illustrations, badge/achievement artwork, challenge templates, and underlying software are owned by Philiabit or our licensors and protected by copyright, trademark, and other laws.

We grant you a limited, personal, non-transferable, revocable license to install and use the app on your own devices in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service, or use our branding without written permission.

Philiabit awards experience points (XP), coins, levels, streaks, and badges for completing habits and challenges. These are virtual items that exist only within the Service for gamification purposes.

• Virtual items have no real-world monetary value and are not redeemable for cash, cryptocurrency, or any tangible item.
• Virtual items may not be sold, traded, gifted, or transferred outside the Service, and cannot be transferred between accounts.
• We may adjust, rebalance, expire, or remove virtual items, badges, or leaderboard entries at any time — including to correct errors or reverse rewards obtained through cheating or a technical exploit.
• If Philiabit introduces a way to purchase coins or premium currency in the future, that purchase will be a license to use the item within the Service, not a sale of property, and will be subject to the applicable app store's payment terms.

Challenges on Philiabit follow one of three formats: Threshold (hit a daily/periodic target), Survivor (lose "hearts"/lives for missed days), or Relay (a team completes a shared goal in sequence). Each challenge has its own rules, schedule, and tracking method set by its creator or Philiabit.

• Progress must be submitted honestly and, where proof is required, backed by a genuine photo or video captured at the time of completion.
• Group and team challenges require good-faith participation — deliberately sandbagging a Relay or gaming a Survivor challenge to disadvantage teammates is not allowed.
• Peer-proof approval (three peer approvals to progress) is a community trust mechanism; approving proof you know to be fake is itself a violation of these Terms.
• We may reverse progress, XP, or rewards obtained through cheating, and may remove a user from a group challenge that repeatedly disrupts fair play.

Philiabit provides in-app tools to report content, proof, or users that violate these Terms or our Community Guidelines. We review reports and may remove content, reverse ill-gotten rewards, issue warnings, or restrict accounts as appropriate.

We are not obligated to take a specific action on any report, but we take safety reports seriously and aim to review them promptly.

We may suspend or terminate your account, with or without notice, if we reasonably believe you've violated these Terms, our Community Guidelines, or applicable law; engaged in fraud, cheating, or abuse; or created risk or legal exposure for Philiabit or other users.

You may stop using the Service and delete your account at any time from Settings → Privacy → Delete Account. See Account & Data Deletion for what happens to your data.

Sections of these Terms that by their nature should survive termination (ownership, disclaimers, limitation of liability, dispute resolution) will continue to apply.

Philiabit is currently free to use. If we introduce optional premium subscriptions or in-app purchases, purchases will be processed by the Apple App Store or Google Play, billed to the payment method on file with your app store account, and subject to that platform's terms.

Refunds for app store purchases are handled by Apple or Google under their respective refund policies; Philiabit does not directly process payment refunds. Subscription terms (price, renewal, and cancellation) will be clearly disclosed before purchase once premium features launch, and this section will be updated accordingly.

Philiabit is a habit-tracking and social accountability tool, not a medical, fitness, financial, or mental-health service. Nothing in the Service constitutes professional advice; consult a qualified professional for medical, fitness, or health decisions.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.

To the maximum extent permitted by law, Philiabit and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or virtual items, arising from your use of the Service.

To the extent liability cannot be excluded, our total liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.

You agree to defend, indemnify, and hold Philiabit harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or any applicable law.

We may add, change, or remove features, challenge formats, or reward mechanics at any time as the Service evolves. We may also update these Terms; material changes will be notified in-app or by email before taking effect, and the "Last updated" date will be revised. Continued use after changes take effect means you accept the updated Terms.

Nothing in this section limits any non-waivable consumer protection rights you have under the law of your country of residence.
